Sex offender sent to prison

A sex offender was sentenced to nine months in prison on Monday for failing to register a change of address with the Fayette County Sheriff’s Office.

On June 14, Fayette County Sheriff’s Office deputies made an address verification check on several registered sex offenders and discovered that the home of Gerald E. Mustard, 68, of 519 Flint Drive in Washington C.H., was vacant, according to Sheriff Vernon Stanforth. Mustard was convicted of gross sexual imposition in July 1994 and was ordered by the court to register as a habitual sex offender, a classification within the registration law.

Mustard pleaded guilty to the charge on Monday in Fayette County Common Pleas Court.

After it was found that he was not living in the residence which he was registered under, an arrest warrant for Mustard was filed in the Washington C.H. Municipal Court, charging him with failure to register a change of address.

“My office continually conducts unscheduled checks of registered sex offenders for the purpose of address compliance,” said Stanforth. “When these offenders provide a residential address at the time of their registration, deputies provide the follow-up measure of ensuring the accuracy of the address given. Those offenders found not in compliance are prosecuted according to law.”

According to an FCSO deputy’s report, it was very apparent that nobody lived in the residence at the time of the verification. “There were no vehicles parked near or around the residence, there were no blinds or screens on any of the windows, and I could see into the residence where there was very minimal furniture inside the house and no property other than an empty bookshelf.”

Deputies were advised that Mustard had moved out on April 24, 2015.

Mustard was indicted on July 10 on one count of failing to register, a felony of the third degree. The indictment alleged that between the dates of April 24 and June 17, 2015, Mustard failed to provide the Fayette County Sheriff’s Office with an address.

After Mustard is released from prison, he may be subject to a three-year period of supervision by the Adult Parole Authority. Mustard was awarded 65 days jail-time credit.
